Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Mindcraft (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.

2. Description of Service

Mindcraft is an iOS application for capturing, organizing, and exploring personal thoughts and notes. The App provides:

• Text and voice note creation and management
• AI-powered tagging, insights, and semantic search
• Telegram message import
• Optional CloudKit sync across devices
• Voice transcription

3. Account and Authentication

The App uses Sign in with Apple for authentication. You are responsible for maintaining the security of your Apple ID and any activity under your account. You must be at least 13 years old to use the App.

4. Your Content

Ownership

You retain all rights to the content you create, import, or store in Mindcraft. We do not claim ownership of your notes, voice recordings, tags, or any other user-generated content.

License to Operate

By using the App, you grant us a limited license to process your content solely for the purpose of providing App features to you. This includes:

• Storing content locally on your device
• Syncing content to your iCloud account (if enabled)
• Processing text for AI-powered features (embeddings, tag suggestions, insights)
• Transcribing voice recordings (when you request it)

We do not use your content to train AI models, for advertising, or for any purpose other than providing the service to you.

Content Responsibility

You are solely responsible for the content you create and store. Mindcraft is a personal tool — the content you create is private to you.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's infrastructure or services
• Attempt to gain unauthorized access to our systems or other users' data
• Use the App to store or transmit malicious code
• Resell, redistribute, or sublicense the App

6. Subscriptions and Payments

Mindcraft may offer premium features through in-app subscriptions. Subscriptions are managed through Apple's App Store and are subject to Apple's payment terms. You can manage or cancel subscriptions in your device's Settings.

We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect active subscription periods.

7. AI-Powered Features

The App uses artificial intelligence to provide features such as tag suggestions, semantic search, insights, and embeddings. These features:

• Process your content on our servers to generate results
• Are provided “as is” and may not always be accurate
• Do not use your content for training AI models
• Can be disabled at your discretion

8. Third-Party Services

The App integrates with third-party services:

• Apple iCloud / CloudKit — for optional data sync, governed by Apple's terms
• Transcription APIs — for optional voice-to-text, audio is processed solely for transcription

We are not responsible for the availability, accuracy, or policies of third-party services.

9. Telegram Import

The Telegram import feature processes Telegram export files locally on your device. We do not communicate with Telegram's servers or access your Telegram account. You are responsible for ensuring you have the right to import and store the content you import.

10. Intellectual Property

The App, including its design, code, features, and branding, is owned by Mindcraft and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

11. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, Mindcraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of the App.

Since your data is stored locally on your device and/or in your personal iCloud account, you are responsible for maintaining backups of your content.

13. Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to suspend or terminate access to the App if you violate these Terms. Upon termination, your locally stored data remains on your device; CloudKit data remains in your iCloud account.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through in-app notifications or updates to this document. Continued use of the App after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
